Consumer Class Action
A “Class Action” is a legal device in which one or more individuals (class representatives) maintain a legal action on behalf of themselves and all others (the “class”) who have been injured by the same business practice(s). Class Actions are often filed against large corporations that use unlawful and fraudulent business practices against many customers. Del Mar Law Group, LLP attorneys have filed consumer protection Class Action lawsuits to enforce important consumer rights under federal and/or California laws that typically involve misleading or false advertising, inadequate disclosure of contract terms, and/or failure to remedy problems or complaints.
Del Mar Law Group, LLP attorneys are currently prosecuting multiple cases based on improper “MADE IN USA” claims by various manufacturers. California law does not permit a manufacturer to claim that a product is “MADE IN USA” unless 100% of the component parts contained in the product are in fact manufactured in the United States. Specifically, Del Mar Law Group, LLP is currently representing California consumers in various class action suits, including but not limited to claims against CVS Pharmacy, Inc. for its sales of CVS-brand eyeglass repair kits (labeled “Made in USA” but containing foreign-made component parts in violation of California law), Bell Sports, Inc. for its sales of the CoPilot Limo children’s bicycle seat products (labeled “Made in USA” but containing foreign-made component parts in violation of California law), and against NeilMed Pharmaceuticals for its sales of sinus and nasal irrigation products (labeled “Made in USA” but containing foreign-made component parts in violation of California law). S.A.,” or similar words when the merchandise or any article, unit, or part thereof, has been entirely or substantially made, manufactured, or produced outside of the United States.
